Terms of Use

1. Agreement
These Terms of Use ("Terms") govern your access to and use of the Libevyn website at https://libevyn.com, the Libevyn web application at /coming-soon, and related services (together, the "Service") operated by Palmarius Technologies (Pty) Ltd ("Palmarius", "we", "us", "our"), a private company incorporated in South Africa with its principal place of business in Cape Town.
By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 18 years old and capable of entering into a binding contract in your jurisdiction. The Service is designed primarily for personal wealth tracking and planning. You may not use the Service on behalf of a third party unless you are authorised to do so.
We may offer the Service to users in South Africa and, over time, in other countries. You are responsible for ensuring that your use of the Service complies with the laws that apply to you where you live.
3. The Service
Libevyn is a software tool that helps you organise and view financial information you enter manually, including net worth, account balances, tax-free savings account (TFSA) contribution tracking, accessible versus restricted wealth, property and mortgage equity, snapshot history, and related planning views. Features may change, be added, or be removed over time.
The Service is built with South African tax and wealth concepts in mind (for example TFSA limits, retirement access rules, and two-pot mechanics). As we expand internationally, country-specific rules and limits may be added or adjusted.
We do not connect to your bank accounts using your login credentials. You enter and maintain your own data. You may export your data and delete your account as described in our Privacy Policy.
4. Not financial, tax, legal, or investment advice
The Service provides information and planning tools only. It does not provide financial, tax, legal, accounting, or investment advice.
Palmarius is not a licensed financial services provider under the Financial Advisory and Intermediary Services Act, 2002 (FAIS), or an equivalent regulator in any other jurisdiction. Nothing in the Service constitutes a recommendation, solicitation, or offer to buy or sell any financial product, nor personalised advice about your tax position, investments, or financial planning.
Calculations, limits, projections, and other figures shown in the Service are estimates based on the information you enter and on published reference parameters (such as statutory tax limits). They are not verified by the South African Revenue Service (SARS) or any tax authority, and may be incomplete, outdated, or incorrect for your circumstances.
Before making financial, tax, or investment decisions, you must obtain advice from a suitably qualified and registered professional who can assess your full situation. You are solely responsible for decisions you make based on information from the Service.
5. Your account and data
You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account.
You are solely responsible for the accuracy, completeness, and timeliness of the financial and personal information you enter. The quality of the Service's outputs depends on the quality of your inputs. We do not audit or verify your data against third-party records.
You retain ownership of the content you submit. You grant us a limited licence to host, process, and display that content solely to operate and improve the Service, as described in our Privacy Policy.
6. Free trial
New accounts receive a 14-day free trial with full access to the Service. No payment card is required to start a trial.
During the trial you may subscribe at any time. If you do not subscribe before the trial ends, your account moves to read-only access: your data is retained, but you cannot add or edit information until you subscribe. We may send reminder emails before your trial ends.
We may change trial length or eligibility in the future. The terms shown at sign-up or checkout apply to your trial.
7. Subscriptions, billing, and payment
7.1 Plans and pricing
Paid access is offered on a subscription basis. Current plans (prices in South African rand, ZAR) are:
- Monthly — R79 per month
- Annual — R790 per year (equivalent to approximately two months free compared to monthly billing)
- Founding member — R59 per month for eligible early subscribers, locked for 12 months, then converting to the standard monthly rate unless otherwise stated at enrolment
Prices, plan names, and features are shown on our pricing page and at checkout. We may introduce new plans, change prices, or offer promotions. Any change applies to you from your next billing cycle unless we are required by law to give you different notice.
At launch, prices are quoted and charged in ZAR. VAT is not added to prices unless stated otherwise at checkout or on your invoice. If we begin charging VAT or offering prices in other currencies, we will update these Terms and the pricing page.
7.2 Subscribing and immediate charge
When you choose a paid plan and complete checkout, you are charged the full plan amount immediately. Your paid subscription period starts on that date. Your payment card is tokenised during that first payment so we can process renewals. There is no separate card-setup fee.
7.3 Automatic renewal
Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on your plan) unless you cancel before the renewal date. By subscribing, you authorise us and our payment processor to charge your stored payment method for recurring fees and applicable taxes (if any).
Before each charge, the price, billing cadence, and next billing date are shown in the app billing section and on checkout screens, in line with South African consumer protection requirements (including the Consumer Protection Act and Electronic Communications and Transactions Act, where applicable).
7.4 Payment processing
Payments are processed by PayFast (or another payment provider we designate). Card details are entered on the payment provider's secure pages; we do not store your full card number. We store only a payment token and masked card metadata needed for billing.
7.5 Invoices and receipts
We issue an invoice or receipt for each successful charge. Invoices are available in the app and may be emailed to you. Invoice records may be retained after account closure as required by law.
7.6 Failed payments
If a renewal charge fails, we will retry on a schedule shown in the app (typically over several days). While payment is overdue, you may retain full access for a grace period. If payment is not recovered within the configured window, your subscription may be suspended and the Service will move to read-only access until payment succeeds. Your data is not deleted because of non-payment.
7.7 Cancellation
You may cancel at any time from the billing section of the app (within two clicks from the billing page). Cancellation takes effect at the end of your current paid period. You keep full access until that date; no further charges are made unless you resubscribe.
7.8 Plan changes
You may switch between monthly and annual billing. Unless we state otherwise, plan changes apply from your next billing date and are not prorated mid-cycle.
7.9 Refunds
Except where required by applicable law, subscription fees are non-refundable once a billing period has started. If you believe you were charged in error, contact us promptly at support@libevyn.com. Where South African law grants you a cooling-off or other remedy, we will honour it.
8. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorised access to the Service, other accounts, or our systems;
- interfere with or disrupt the Service or its security features;
- scrape, reverse engineer, or copy the Service except as permitted by law;
- use the Service to provide regulated financial advice to third parties without proper licensing;
- submit false, misleading, or harmful content.
We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the Service or other users.
9. Intellectual property
The Service, including its software, design, branding, documentation, and underlying technology, is owned by Palmarius or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to use the Service in the ordinary course.
10. Third-party services
The Service relies on third-party providers (for example cloud hosting, authentication, email, analytics, and payment processing). Your use of those services may be subject to their terms. We are not responsible for third-party websites or services linked from the Service.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, PALMARIUS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that calculations or tax parameters will always be current or correct.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PALMARIUS AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ZAR 500.
Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for fraud or gross negligence where such limitation is not permitted).
13. Indemnity
You agree to indemnify and hold harmless Palmarius from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your data, your breach of these Terms, or your violation of any law or third-party right.
14. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice (for example by email or in-app notice) before the changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and cancel your subscription.
15. Termination
You may close your account at any time via the app or by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (with reasonable notice where practicable).
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of South Africa, sitting in Cape Town, subject to any mandatory consumer protections in your country of residence that cannot be contracted away.
